Regulation of the digital economy in France and Europe

France wholeheartedly supports the efforts being taken by the European Commission to guarantee the conditions for fair and loyal competition between digital stakeholders in the EU. Three decrees have just been signed by Bruno Le Maire, Minister of Economy and Finance, and Mounir Mahjoubi, Minister of State for the Digital Sector, with a view to tightening the transparency and loyalty obligations underpinning digital platforms in France.

For several months now, France has been working hard at European level to update the tax rules that are no longer adapted to tech giants, their business model and their aggressive tax planning practices which are hampering the growth of European businesses – not least startups – and taking a toll on Member States' public finances.
It was following France's initiative that this matter of digital taxation was put on the agenda of the Tallinn Digital Summit between European Heads of State and Government on 29 September just gone, to ensure that tech giants pay a fair contribution on their earnings in the country where this turnover is actually made.
A fairer and more effective European digital economy also requires greater transparency and greater loyalty on the part of digital platforms: search engines, social media websites and price comparison websites. Three decrees were signed on 5 October by Bruno Le Maire and Mounir Mahjoubi with a view to tightening the transparency and loyalty obligations.
In the future, the platforms will have to specify their listing and classification criteria, and especially:
  • in what way the amount of their remuneration is a factor in the order in which content is presented;
  • whether or not the consumer opinions they publish have been verified, and according to what conditions.
Collaborative economy websites will also be required to provide information about the type of seller (professional or otherwise) and the contact service fees amount.
